Conditions of chartering with Bareboat Charters Limited

  1. Cancellations:
    • Cancellations more than 15 days prior to charter commencement, a full refund will be given less the $50 cancellation fee.
    • Cancellations less than 15 days from the commencement date will receive a full refund less the $100 cancellation fee.
  1. Bareboat Charters reserves the right to cancel a charter:
    • If for a specific reason a vessel can not be made available for charter.
    • Adverse weather conditions.
    • If Bareboat Charters at the charter commencement are not satisfied with the ability of the charterer to sail, handle, navigate and respect the charter vessel, or alternatively at any time during the charter period consider the vessel to be in an unsafe location, or if the actions of the charterer are endangering the vessel, the occupants or any third party. Bareboat Charters reserves the right to either: Provide a professional skipper at the charterer’s expense, terminate the charter without refund, recall the vessel to any mooring or anchorage which it considers to be secure.
  1. Vessels must remain in the designated survey area at all times with numbers of people not exceeding the number allowed onboard under the vessel’s survey.
  2. Vessels must be secure on anchor or a mooring one hour before darkness. Vessels must not manoeuvre within the hours of darkness unless in an emergency or permitted by Bareboat Charters by prior arrangement.
  3. The charterer must adhere to current M.A.F. fishing regulations.
  4. No animals/pets are allowed on charter vessels.
  5. No firearms are allowed on charter vessels unless arranged prior.
  6. Smoking is not permitted on any vessel.
  7. All rubbish must be returned to the marina for disposal.
  8. The skipper or person in control of the vessel will not consume alcohol or any judgement impairing substances during the hire period.
  9. The charter vessel must at all times be under the control of the designated skipper.
  10. The skipper must be a minimum of 25 years of age unless specifically agreed upon by Bareboat Charters.
  11. Everyone on board will have to abide by the Maritime Rules and Regulations.
  12. The range limit is the area of Hauraki Gulf (Rangitoto, Motuihe, Motutapu, Rakino, Waiheke, Rotoroa, etc). However, for long-term boat hire, you can trailer it to your favourite location – eg Bay of Islands.

Conditions of payment:

  1. A booking is confirmed after the payment of a deposit of 1/3 of the basic charter fee and satisfactory completion of the Booking Application. The balance of the charter is to be paid 15 days prior to the charter commencing.
  1. Self-drive charters:

The security bond is to be paid by credit card/cash/Bank Cheque prior to or on arrival for the charter. Security Bond is $500. The security bond will be processed within 20 days of the termination of the charter. (If major damage occurred the 20 days could be extended and the charterer will be notified.) The following costs (if applicable) will be charged to your credit card or deducted from the Security Bond paid:

  • Loss or damage to charter vessel or equipment.
  • Cost of refuelling the vessel.
  • Defrayment of costs due to the vessel not being returned at the scheduled time. Extenuating weather conditions are exempt.
  • Any other outstanding debts on the client account (fishing tackle hire etc)
  1. Insurance:

All vessels are fully insured against fire – marine & collision risks – third party liability. If during the charter period damage or loss is caused, the charterer is liable as follows:

  • To the full extent of loss and damage which in Bareboat Charters opinion is not claimable against vessel insurers.
  • To pay the full excess on vessel insurance policy.
  • To pay the full amount of loss or damage should the claim be declined by the Insurance Company for any reason.
  • All equipment supplied is used by the charter party at their own risk.
  • In case of an Insurance claim, fuel used and other outstanding debts (if applicable) will be charged in addition to the Security Bond.

Note: The agreement will be sent and have to be signed off before or on arrival for the charter. No signed agreement can result in the charter not taking place and no refund will be applicable.
